Peru Reach Regulation for Various Sectors

In recent years, there has been a significant rise in efforts surrounding the Globally Harmonized System (GHS) and chemical management. Reflecting both regional and national trends, Peru enacted the decree 1570, in which was approved the law  of Chemical Substances Regulation  (Ley de Gestion Integral de Sustancias Quimicas) which incorporates GHS guidelines. The adoption of risk assessment guidelines is anticipated in 2025, with the establishment of the National Chemical Substances Registry (RENASQ) scheduled for 2026. By 2027, measures to reduce and manage risks are expected to be put in place. In 2028, chemical mixtures will begin to be registered in RENASQ, with the implementation of risk assessments projected to start in 2029.

Adoption of GHS

The implementation of the Decree1570 has been done integrating the 6th version of the GHS. The decree approves the law for the management of chemical substances.

Objective

The purpose of the regulation is to establish strategies for the protection of the health of individuals and the environment through the adoption and implementation of management mechanisms for chemical substances, with a focus on the prevention of risks to health and/or the environment.

Exemption

  • Natural and man-made radioactive (in the process of research prior to market launch, no commercial value, resulting from chemical reaction that occurs unintentionally,  non isolated intermediates)
  • Pharmaceutical products for human and/or veterinary use
  • Medical device for human and/or veterinary use.
  • At the finished abellin stage, including the upstream activities of packaging, repackaging or repackaging of: food and food additives, used for animal feed and as feed additives; and medical devices (including cosmetic products, household abelli products and personal abelli products) authorised and recognised with Mandatory Health Notification (HNS);
  • Agricultural chemical pesticides, fertilisers and other agricultural inputs.

Non-compliance

Title IX Art. 72 Ministerial Resolution Nº 00214-2024-MINAM: La multa no puede ser mayor al 10% de lo que la persona ganó el año anterior. La persona debe mostrar pruebas de sus ingresos o dar una estimación de lo que espera ganar. Sin embargo, este límite no se aplica si la persona ya ha incumplido antes o si ha realizado actividades en áreas prohibidas.
